Editor's note

This investigation, triggered by a domestic manufacturer's complaint, signals heightened scrutiny of supply-chain origin claims. Buyers supplying U.S. government facilities should verify domestic sourcing compliance, as enforcement could extend to medical aesthetics products, posing regulatory and supply-chain risks.

The Trump administration has removed 22 foreign-made flatware products from the federal procurement platform GSA Advantage! after an investigation revealed they were falsely marketed as 'Made in America.' The crackdown signals heightened scrutiny of supply-chain origin claims, which could extend to medical aesthetics products sold to U.S. government buyers.

Investigation and enforcement

The U.S. Small Business Administration (SBA) and General Services Administration (GSA) conducted a three-week probe that led to the de-listing of 22 foreign-made flatware items from GSA Advantage!, the primary e-commerce portal for federal agencies. The action follows a White House Small Business Summit where President Donald Trump and SBA Administrator Kelly Loeffler met with domestic manufacturers to address procurement loopholes.

Regulatory basis

The enforcement stems from an Executive Order issued by Trump directing federal agencies and the Federal Trade Commission to aggressively target fraudulent 'Made in America' claims. Violations include the Buy American Act, the Trade Agreements Act, and the Berry Amendment, which mandates that specific military-use items be entirely U.S.-produced.

Industry trigger

The probe was initiated after Sherrill Manufacturing, the sole remaining U.S. manufacturer of 100 percent American-made stainless steel flatware, warned that China-based competitors were falsely claiming domestic origin for items only partially assembled or finished in the United States. Loeffler stated, 'The Trump Administration is sending a clear message that we will not tolerate foreign impostors that hijack Made in America labels.'

What buyers should watch

Medical aesthetics importers and distributors supplying U.S. government or military facilities should verify that their products meet strict domestic sourcing requirements. The SBA has introduced a 90 percent 'Made in America' loan guarantee for small manufacturers and the 'Make Onshoring Great Again' Portal, which connects businesses with over one million domestic suppliers. These incentives may shift procurement preferences toward U.S.-made aesthetic devices, injectables, and consumables.
